Retail Food to pay certain franchisees as ACCC settles legal action

On 23 December 2022, ACCC announced that it has accepted a court-enforceable undertaking from Retail Food Group Ltd (ASX: RFG) in which Retail Food Group agreed to make payments to and waive historical debts of several affected current as well as prior franchisees, concerning the purchase of certain corporate stores by these franchisees.

Besides, Retail Food Group will pay AU$5 million to franchisees of Michel Patisserie stores who paid taxes into that franchise’s marketing fund between 1 July 2012 and 30 June 2017.

As a result, the parties have decided to settle the proceedings which ACCC started against the company in December 2020 related to the supposed unconscionable conduct and false and misleading representations made in its dealings with franchisees.
