ASIC started civil proceedings against Mercer for misleading its customers

ASIC started a civil proceedings against Mercer Financial Advice (Australia) Pty Ltd for supposedly making false representations to its clients related to fees charged plus services that were not offered. It also did not gave fee disclosure statements.

As per ASIC, Mercer in between July 2016 and June 2019 made misleading representations on over 5,500 times. It did not provide fee disclosure statements and gave wrong statements, to over 2,100 customers. Further, it could not do all things essential to confirm the financial services enclosed by its licence are provided efficiently, honestly and fairly.

Mercer has already completed a remediation program for over 3,400 customers who paid fees for financial advice. However, they were not provided the services during the time frame January 2012 to June 2019, which resulted in compensation of ~AU$45 million.
